If you've been injured...
We can help.
Experienced, proactive & dedicated, Van Riper Nies attorneys are committed to protecting your rights.
Van Riper Nies represents individuals and families who have suffered an injury or lost loved ones due to the fault of others. Our firm motto is that we leave no stone unturned in the prosecution of our clients injury claims.
We are unique as a plaintiff law firm. One of our partners, Tim Nies, is a military veteran and a proud lifetime member of the Disabled American Veterans. When serving as an Airborne Ranger with the 75th Ranger Regiment, he sustained a line-of-duty knee injury during a parachute mission. Tim fought hard to get his life back together and begin his career as an attorney. Tim, more than many personal injury attorneys, knows how it feels to sustain and overcome a life-altering injury. After the Army, Tim began his attorney career defending personal injury cases for insurance companies and large corporations, including Fortune 500 companies, where he learned the workings of insurance companies. Our other firm partner, Christian Van Riper, was selected as a Law Clerk for the Florida Supreme, which is an honor only a few attorneys are selected for. Thereafter, Christian began his legal career as a State Attorney, where he tried multiple serious felony cases out of the St. Lucie County office. This experience affords our personal injury law firm valuable insight into the struggles of our clients face after serious injuries, how their cases are defended, and important trial experience right here in the Treasure Coast.
Our past experience on the insurance defense side also gives us credibility with the insurance companies, and our knowledge of how insurance companies evaluate cases proves effective during the pendency of injury cases, during negotiations and at trial. To learn more about our trial lawyers, we invite you to review our individual attorney biographies.
Tim and Christian have known each other most of their lives and work all personal injury cases as a trial team. This approach benefits our clients on two levels. First, both Tim and Christian are extremely familiar with the details of our clients’ cases and are able to collaborate to effectively come up with a litigation and trial plan. Second, our clients are able to speak with an attorney about their cases at any time of the day and night. We are known for the personal attention we are able to provide to our clients. Our clients are usually pleasantly surprised to be able to speak us after hours and on the weekends.
In Florida, products sold and provided to consumers should meet the ordinary expectations of consumers. If a product is dangerous, then the manufacturer, distributor and seller can be held accountable for any harms and losses that from the use of the unsafe product.
In Florida, there are three elements that must be established by the plaintiff bringing a lawsuit in order to prevail in any products liability cause of action. The plaintiff must prove:
1. that a defect was present in the product; 2. that it caused the injuries complained of; and 3. that the defect existed at the time the manufacturer or retailer parted with possession of the product.
Once it is determined that a product caused the injury, the plaintiff must establish that is was defective. A product may contain a design defect, a manufacturing defect, or it may be defective because the seller or manufacturer failed to adequately warn of the product's dangers, such as placing proper warning labels on power saws.
Florida courts have also ruled that the defect must have been present at the time the product left the possession of the manufacturer, supplier, or retailer. All our personal injury cases are taken on a contingency fee basis, meaning we do not take a fee or charge any costs unless we win.
